The sentencing case is scheduled to resume on Wednesday.

After Trump took office, Bergdahl's lawyers argued the judge should dismiss the charges because of Trump's comments, claiming Trump violated Bergdahl's due-process rights and saying it would not be possible for Bergdahl to get a fair trial. He said that when they recite, the whole military is approaching for you, they are telling the truth.

Bergdahl pleaded guilty last week to one count of "desertion with intent to shirk important or hazardous duty" and one count of "misbehavior before the enemy by endangering the safety of a command, unit or place".

He said the military has an open-door policy for service members to voice concerns about chains of command, so Bergdahl had no reason to desert.

He faces up to life in prison. When asked about the case, Trump said that he couldn't discuss it, "But I think people have heard my comments in the past". Trump also said in December 2015 that Bergdahl should be thrown out of a plane with no parachute. He called the prosecutor's argument about the latest statement "a strained interpretation". Now, the disgraced military officer awaits his sentencing.

Nance told Bergdahl and the attorneys that his own judgment had not been compromised by what Trump said.

A Taliban prisoner swap that won his release in 2014, organized by the administration of then-Democratic President Barack Obama, was criticized by people in the military and by Republicans.

Nance told the defense that, regardless of what Trump said, "I don't have any doubt whatsoever that I can be fair and impartial in the sentencing in this matter". He said he had carefully avoided news about Bergdahl's case, and had not seen Trump's comments until they came up in the defense motion. But on October 16, the president spoke about Bergdahl again. Investigators said Bergdahl suffered from schizotypal personality disorder when he left his post.

On Oct. 23, Judge Nance allowed attorneys to question him regarding the impact of Trump's statements, and he ultimately delayed the sentencing until Oct. 25 so he could thoroughly consider the defense motion, the Associated Press reports.

"Here, it could be the guy I pass in the corridor who's going to sign the paper that sends me away for life", he says.
